New Regulation Changes Bonding Requirements
Dental sleep medicine involves using oral appliances to treat sleep disorders such as snoring and sleep apnea. A medical provider prescribes the appliance, and dentists may supply the items to their patients.
While DMEPOS providers are required to obtain a surety bond per 42 CFR § 424.57(d)(15)(ii), but had exempted dentists from that requirement. The Center for Medicare and Medicaid Services (CMS) recently changed the surety bond requirement for dentists who provide oral sleep medicine appliances.
Dentists who assist their patients with DMEPOS services are no longer exempt from the surety bond requirement. Dentists must obtain a $50,000 bond to assure compliance with the CMS billing program and to maintain their Medicare Provider Transaction Access Number (PTAN).
Bonds must be provided to the National Suppliers Clearinghouse Medicare Administrative Contractor within 60 days of being notified that they are no longer exempt from the bond requirement.
